Bethesda's request for redaction revealed

<p>As DAC has previously reported, Bethesda filed to have certain lines redacted from the 218 page transcript of their court case with Interplay. Duck and Cover has now obtained this filing. Here is what Bethesda doesn't want us to know:</p>

<p><em>This motion is made under Local Rule 105.11 on the ground that the testimony sought to be sealed by redaction contains confidential information and trade secrets about the practices of Plaintiff. Disclosure of this confidential information and trade secrets would destroy their value by placing them in the public domain and making them available to Plaintiff&rsquo;s competitors. There is no alternative to sealing available to Plaintiff: once the information is made public, the trade secret and confidential nature of the information will forever be lost.

A. Plaintiff&rsquo;s Game Development and Business Practices

Plaintiff requests that the following lines concerning the development of a particular game not at issue in this proceeding be redacted by blacking out:

Page 94, lines 8-16
Page 96, lines 6-15
Page 137, line 19 through Page 138, line 12.</strong>

The testimony that Plaintiff seeks to redact concerns confidential and trade secret information about the timing of game development, financial budgets, number of employees working on production and other information concerning the current development of this game. Plaintiff has spent years determining the confidential and trade secret business plans for this game, and has kept the particulars of its plans and production confidential. Publishing the transcript publicly through, for example, Pacer, would provide Plaintiff&rsquo;s competitors valuable information that they could use in competition with Plaintiff. Therefore, Plaintiff respectfully requests that this Court redact the testimony concerning the game.</em></p>

<p>We will try and get a hold of this information, if possible, before the redactions have gone through. So if you live in Maryland, get to a public terminal at a court and let us know what you find out!</p>
